B-BBEE Commission to issue its findings on the complaint lodged by the Democratic Alliance

The B-BBEE Commission confirms that it has finalised its investigations emanating from complaints lodged by Mr Dean Macpherson of the Democratic Alliance on 05 March 2018, against Eskom Holdings SOC Limited, Trillian Management Consulting (Pty) Ltd, BEE Matrix (Pty) Ltd, Tegeta Exploration and Resources (Pty) and Ltd Optimum Coal Mine (Pty) Ltd. In essence Macpherson alleged that Trillian Management Consulting (Pty) Ltd, Tegeta Exploration and Resources (Pty) and Ltd Optimum Coal Mine (Pty) Ltd submitted invalid and/or fraudulent B-BBEE certificates and B-BBEE Sworn Affidavit to Eskom Holdings SOC Limited for procurement purposes. The B-BBEE certificates for Tegeta Exploration and Resources (Pty) and Ltd Optimum Coal Mine (Pty) Ltd issued by BEE Matrix (Pty) Ltd.
The B-BBEE Commission issued its final findings to the parties to the complaint on 12 July 2019 and has noted that Democratic Alliance has issued a media statement in regard to these complaints. The B-BBEE Commission will publish its findings in due course subject to section 13J (7) (b) of the B-BBEE Act which allows for a period of 180 days for a judicial review process that may be pursued if any of the parties wish to do so. The B-BBEE Commission performs its mandate impartially, without fear, favour or prejudice, as guided by the B-BBEE Act, and will continue to respect this process.
The B-BBEE Commission was established in terms of Section 13B of the amended B-BBEE Act No 46 of 2013 effective from 6 June 2016. The Commission’s mandate, amongst others, is to supervise and encourage adherence to the B-BBEE Act in the interest of the public, to promote good governance and accountability by creating an effective and efficient environment for the promotion and implementation of the objectives of broad-based black economic empowerment.
