Extension of time for submission of Major B-BBEE Transactions / Compliance Reports and Filling of correspondence and documents to the B-BBEE Commission
As you are aware, the President has announced the extension of the lockdown as part of the integrated measures to prevent and contain the spread of COVID-19 in the country, and it is our responsibility as public and private entities to mitigate the impact of COVID-19 on our economy and citizens. Please take note of the following notice applicable with immediate effect:
Filing of Major B-BBEE Transactions
The normal timeline for filing the major B-BBEE transaction is within 15 days of the conclusion of the major B-BBEE transaction. The parties that concluded or will conclude a major B-BBEE transactions from 11 March 2020 to 30 April 2020 are granted indulgence to file the major B-BBEE transaction for registration within 30 calendar days following the end of the lockdown period announced by the President.
Submission of Compliance Reports
All JSE listed entities, organs of state and public entities, and SETAs that are required to submit Compliance Reports any time from 26 March 2020 to 30 April 2020 may submit their compliance reports within 30 calendar days following the end of the lockdown period announced by the President.
Submission of correspondence/documents
All stakeholders that have a timeline that falls on a date that is during the lockdown period announced by the President for submission of responses allegations in a complaint, responses to findings in an investigation, responses for alignment of major B-BBEE transactions and any relevant deadline are granted indulgence to submit these to the B-BBEE Commission within 30 calendar days following the end of the lockdown period announced by the President.
Office Closure during Lockdown
Please note that our offices will be closed during the lockdown period and as a result, we will not be accepting any document/correspondence relating to a complaint, transaction, compliance report or any other process in the regulations filed by email or delivered to our offices during this time. Our offices will officially reopen on 4 May 2020 for filing or submission of any document/correspondence in this regard.
Please note that no party is entitled to the indulgence provided in this notice but it is granted on the basis of good cause given the lockdown as announced by the President to enable the parties/entities to properly prepare and file or lodge with the B-BBEE Commission after the lockdown period. Thus, the timeline for any document or correspondence submitted during the lockdown period will only be counted with effect from 4 May 2020. We will monitor the situation and adjust the timelines as may be necessary post the lockdown period announced by the President.
